The Taco Bell situation remained in the news as the Centers of Disease Control and Prevention issued a statement:
CDC is working with state and local health officials, the Food and Drug Administration (FDA), the Department of Agriculture (USDA), and the restaurant chain to determine what food caused the outbreak. These investigations include an ongoing investigation that involves interviews of ill and well Taco Bell restaurant patrons about what food items they consumed. These food items include a variety of different ingredients.
By comparing foods consumed by ill and well persons, investigators can show statistical links between illness and consumption of particular food ingredients. Public health investigators have identified a few ingredients that were consumed more often by ill persons than well persons and were statistically linked with illness: lettuce, cheddar cheese, and ground beef. This analysis also indicates that onions of any type are not linked to this outbreak.
The investigators have also gathered additional information about the locations of involved restaurants, the patterns of distribution of food ingredients, and the characteristics and preparation of food ingredients. Evaluation of all these data indicates that shredded lettuce consumed at Taco Bell restaurants in the northeastern United States was the most likely source of the outbreak.
Because multiple Taco Bell restaurants were involved during the same time period, contamination of lettuce likely occurred before reaching the restaurants. Health officials and the restaurant chain are working collaboratively to learn more about the shredded lettuce to determine how it may have become contaminated.
So their best guess now is shredded lettuce, meaning the poor guys at Boskovich Farms were implicated for nothing. They have been a class act throughout the situation.
The Pundit, though, is not so certain the CDC is correct on its calling it lettuce. At retail, items are sold discretely, and consumers, in general, can be expected to remember what they bought. At Taco Bell, you can order many things on the menu that are made from the same ingredients. In addition, consumers are less likely to remember an item such as scallions, which are a very minor part of most dishes.
Remember the CDC’s survey methodology had them implicating organic spinach and many other brands and processors of spinach for weeks after the start of the spinach/E. coli situation. Our confidence in its ability to detect between tacos, salads and burritos, all containing many of the same items, is not very high.
We received a bunch of messages today from people telling us about catching the President of Taco Bell on television trying to reassure the public that eating at Taco Bell is safe. It almost certainly is safe. Even at the peak of the outbreak, considering the number of restaurants and the number of servings per day sold, the odds of anyone walking into a Taco Bell and getting seriously ill were always infinitesimal.
Time has passed, the specific food in question has long since been consumed or thrown out, the restaurants implicated have been sanitized.
All that is fair and worth saying.
But he also keeps repeating that as part of their effort to make sure their food is safe, they changed their produce supplier.
This is really a horrid route for Taco Bell to take.
First — Where is the CEO of Yum!Brands? David C. Novak is the CEO of Yum!Brands. The guy they are trotting around from Taco Bell is a subordinate of his. This company is sending the clear message to consumers that Yum!Brands is not concerned and doesn’t care. Which PR agency told them that was a brilliant strategy?
Second — What are they doing to help the sick people? A bunch of people go to your restaurant and get sick. You can say you regret that and offer to pay at least the uninsured portion of their medical bills. To do nothing, to just raise a middle finger to people and say sue me… well, that pretty much guarantees that the victims will do that.
Third — You are either proud of the supply chain you built and stand by it or you acknowledge fault and improve it. But it is just low to say everyone did everything perfectly, but we fired them anyway. Don’t they know that people have jobs working for these companies? Did they make arrangements that anyone who Ready Pac needs to let go will be picked up by their new supplier? Do they take pride in that, in addition to getting people sick, they now are ruining the Christmas of families where the bread winner is now suddenly unemployed? Is there no sense of decency there?
Fourth — They have the nerve to then blame the whole produce industry for its problems:
[Taco Bell President] Creed said no produce outlet was safe unless farms were.
“We believe there’s a need for thorough review of the produce supply system in our country today,” Creed said.
“We need to review whether there should be better controls across the entire industry to assure safety at the farm level so that consumers know that their produce is perfectly safe — no matter where they purchase it — in a restaurant, supermarket or farm stand,” he said.
He called for an industry coalition made up of regulators, competitors, suppliers, and other experts to develop improved guidelines to safeguard produce and public health.
Yum!Brands is, by unit count, the largest foodservice operator in the world. When they tell suppliers to jump, the suppliers ask, “How high?” Yum!Brands has it in its power to dictate its own supply chain. The truth is that general produce industry standards are irrelevant to them.
But beyond this, to make these sorts of vague charges against a whole industry is wrong. Especially because they have shown no interest in being involved. The chairman of PMA’s Board of Directors last year was Janet Erickson of Del Taco, another quick-serve chain — so there has been plenty of opportunity to get involved, and Yum!Brands has had no interest.
More recently, we had the Buyer-led Food Safety Initiative and we can see Denny’s on there. Yum!Brands didn’t sign up.
It is as if this company wants to push responsibility down to lower level people and then blame its produce supplier and the whole produce industry.
It is such a shame. The right answer is obvious: The CEO of Yum!Brands should have been out in front from the first minute. He should have expressed sympathy for those who got sick in his restaurants and offered, in material ways, to help them. He should have expressed confidence in the supply chain Yum! has developed and said that if they can find a problem they would fix it.
Instead the company and its executive come across as only “looking out for #1”. It won’t help food safety and it won’t help Yum!Brands.
It is obvious that nobody would even bother to write the story of a salmonella finding on a small sample of Texas-grown, Canadian packed Queen Victoria brand curly spinach at one retail store in Atlantic Canada if it wasn’t for the hyper-sensitivity to foodborne illness and spinach that we are living in right now.
Nobody is sick and the test is not confirmed still. The only information we have is that Ippolito Fruit & Produce Limited issued a Recall Communication Letter and the Canadian Food inspection Agency issued a Health Hazard Alert.
We asked Pundit Investigator and Special Projects Editor, Mira Slott, to get the full story. She spoke to both a representative of the processor and the Canadian Produce Marketing Association:

Q: Could you put the news about your spinach recall in perspective and clear up any concerns?
A: Unfortunately, we’ve had quite a bit of interest in this recall. There has been a heightened awareness of food safety problems leading to misperceptions and false conclusions.
This is where we’re at: We bring product in from the field farm level. When raw product comes in, and again when it is packaged, samples are sent out for lab testing.
On the 21st of November, the curly leaf spinach was shipped direct from a grower in Texas and arrived at our facility on the 24th. We ran that product over a two-day period. We took one raw lab sample and one finished on the 24th, and two more on Saturday the 25th. All four lab samples were sent out and came back negative for Salmonella, E. Coli and Lysteria. Product was shipped with a best-before date of Dec 7.
Q: When and where was Salmonella suspected?
A: On Sunday evening of December 10, we got a call from the Canadian Food Inspection Agency (CFIA) saying it had a positive test for Salmonella in Atlantic, Canada. This sample product was taken from a single store shelf in Atlantic. I don’t know the name of the store. The product had expired on December 7, and in all likelihood was off shelves at the retail level. Nobody had reported any illnesses up through this time, but someone could have still had the product in the refrigerator, so we did a voluntary recall. Unfortunately, these things get misunderstood and take on a life of their own.
Q: So to clarify, there have been no reported illnesses of any kind linked to the productwithin the recall parameters, and only one store where samples showed Salmonella in initial testing?
A: No reported illnesses, no problems at all. We were just trying to be forward by conducting the voluntary recall. Even one person getting sick would be unacceptable and that’s why we didn’t want to take any chances even though it was the sixth day after the best-before date on the product.
Q: Do you have any information or thoughts on the source of the Salmonella?
A: I don’t know where this potential Salmonella could have arisen. It could have happened anywhere along the food supply chain; leaving the building, during the transportation process or somewhere at retail.
Q: Where did the product come from in Texas? Who was the grower?
A: At this particular time of year, the curly leaf spinach we’re repacking comes from growing areas in Texas. The baby spinach comes out of Yuma. Right now, I do not want to give you that grower’s name. In no way, shape, or form do I want this person implicated. Look what happened in the Taco Bell case. Companies supplying green onions are blamed when the product testing positive for pathogens turns out to be white onions and that strand is unrelated to the outbreak.
Q: Sounds like you empathize with companies put in this predicament.
A: I’m sitting here in the situation I’m in, looking over our food safety protocol procedures front to back, and can’t find anything that would indicate we did anything wrong. We just put in a state-of-the-art processing line.
I can’t guarantee safe handling once product leaves our facility and goes to a third party carrier. It looks like there’s no problem there either. Then there’s potential for contamination at the warehouse and at the retail level.
From the field level all the way through the supply chain we control, if we consider there’s a problem, we stand up and will be accountable, but at this stage, there is no problem we can see.
Q: Is there any more testing going on?
A: We asked the CFIA for a retest, but because of the lot they used, the agency was not able to confirm the original results. We are taking CFIA at their word that testing is accurate.
The sad reality is by the time we were notified of the potential Salmonella problem, it was basically four days after product was off of code. We have not had one customer call to date that had this product in stock.
The story is anti-climatic but there are a few interesting things that come out of the interview. First, here is a processor doing testing both upon receipt of product and before shipping final product. This should be standard procedure for all processors. Kudos to Joel and the team at Ippolito.
Second, we see a possible problem with “best if used by” dates, which we also saw in the E. coli/spinach situation. It is very clear that these statements should be stronger: “Dispose of after December 7, 2006,” for example. Or use new technology that will turn a marker a different color if too much time or temperature has passed.
Third, we don’t understand how the government couldn’t do a confirmatory test.

Q: What is your take on the news advisory about Salmonella-tainted spinach in Canada?
A: It’s a free-for-all out there, and fresh produce is the new game on the menu.
It could have been a consumer that handled chicken and then handled spinach. This is not a food safety outbreak. There are no illnesses associated with consumption of this product. This is a controlled and proactive approach to the possibility of the potential risk associated with Salmonella contamination.
To me, because I’m aware of what our food inspection systems in Canada are like, it demonstrated they are working effectively, and that the supplier also has a strong response system as well.
Q: So from your perspective, what else could be done at this point?
A: Produce is grown in an open environment. It’s a controlled and usually manageable risk. Very rarely do we have food safety outbreaks in Canada associated with produce. The preliminary testing indicated the curly leaf spinach could have been contaminated with Salmonella. The preliminary tests are not 100 percent accurate. Usually it takes five days to have culture results back from labs. We don’t know exactly what caused the problem.
Perishable product doesn’t stay in the market for a long time. The U.S. spinach/E. coli outbreak is a good example of how the problem was quickly traced back to those farms, but we still don’t know the true source. There are only so many ways we can control environments and that’s why we have other technical food safety steps along the supply chain.
In the case of the Ippolito Produce recall, the product was Savoy curly leaf spinach. 99 percent of the time it’s cooked anyway. Even if eaten raw, usually the residual bacteria is taken care of by washing. With news of all these outbreaks, it is becoming increasingly difficult to provide the correct context for consumers.
I’m not saying consumers don’t have the right to be concerned. But it’s our job, through the CFIA for example, to take as many steps as possible to reduce possible risks. At the same time, the recall was based on sample tests on a few bags at one retail location. Just because they showed up with presumptive positives of Salmonella, one cannot assume the existence of Salmonella. Preliminary testing of green onions at Taco Bell turned out to be negative in retesting, and now the source of the problem is being re-assessed.
We expecially like two of Heather’s lines:
This is not a food safety outbreak. There are no illnesses associated with consumption of this product. This is a controlled and proactive approach to the possibility of the potential risk associated with Salmonella contamination.
And. . .
Just because they showed up with presumptive positives of Salmonella, one cannot assume the existence of Salmonella. Preliminary testing of green onions at Taco Bell turned out to be negative in retesting, and now the source of the problem is being re-assessed.
Remember them well. They may come in handy one day.
We received a note regarding our coverage of food safety and the spinach/E. coli crisis:
The interaction between organic and a spinach crisis revolving around Natural Selection Foods was bound to raise questions about organics. The minute people heard E. coli and Natural Selection Foods, many said it could be poorly composted manure. There was real fear that it could destroy the whole organic movement.
Natural Selection Foods got ahead of this issue fast and issued a statement exonerating organics. The statement, though technically correct, caused some controversy since the FDA and CDC had not ruled out any product.
In any case, we published a piece entitled Organic Dodges A Bullet ,which dealt quite thoroughly with the issues regarding organic agriculture.
When government food safety people were telling industry leaders that, absolutely, organic product is implicated, we thought this odd as it seemed unlikely that both organic and conventional product from the same plant would have an E. coli outbreak at the same time. This led us to hypothesize that, perhaps, it was all organic product but some was simply being sold as conventional. We never got a formal statement from anyone on this issue, but we have been told that Natural Selection Foods informed the firms it co-packed for that it was not organic product.
Equally, nobody has issued a formal statement saying that the implicated ranch was transitional — but that has been told to the Pundit by more than 20 people deeply involved in Salinas agriculture, and now Jeff is signing his name to it.
It certainly raises the stakes for organics. Although the government has focused on wild pigs since the same strain of E. Coli 0157:H7 that was found on the spinach bags was found in the digestive tract of a wild pig, that doesn’t prove anything. It is possible, for example, that both the E. coli 0157:H7 on the spinach bags and in the digestive tract of the pig could have had a common origin — such as incorrectly composted manure used to fertilize the organically grown acreage that was being marketed as conventional since they didn’t have their three-year transition finished.
We don’t know. Presumably the government is considering this possibility.
The Pundit has, on several occasions, stated the opinion that the use of manure in modern commercial agriculture is unacceptable and should be banned. Certainly we need, at a minimum, a much more rigorous program to make sure compost is properly done. This would have to include a third-party certification.
Jeff’s broader point about sulfur, oils, etc., was dealt with in Organic Dodges A Bullet and raises a difficult question. As we wrote:
Both sulfur and copper are toxic substances to many different creatures, and both remain in the soil and environment for extended periods. Is it just obvious to everyone that fields laced with sulfur and/or copper are somehow healthier for people or the environment than fields where a synthetic substance was used?
But the bigger issue on these things may be marketing. Many people think that organic means “grown without pesticides, fungicides and chemicals” — this isn’t true, and so products that are piggybacking on that image are marketing deceptively. These things usually come home to roost and with the fissures in the organic community over issues such as “locally grown,” it will probably be soon.
The Pundit extends appreciation to Jeff for being willing to stick his neck out and thus help lead the industry discussion on this important issue.
There is an ad-hoc group that started it all, the National Restaurant Association has its group working on a program and the Food Marketing Institute has a conference planned. All these buyer-led initiatives can get confusing, so to assist the trade in keeping track of them all, we are publishing this recap of coverage all in one place.
As new developments, occur we will continue to update this recap to help keep the trade organized on this important subject.
On September 25, 2006, in the midst of the spinach crisis, we published The Role of Retailers And The Future Of Food Safety, which pointed out that it is the “representations and warranties” that buyers demand that define the food safety programs we get:
“…in the end, the strength of our food safety systems is at least as dependent on what retailers demand as they are on what the government does for the simple reason that what retailers pay for is what they are going to get.”
Then in the issue of the Pundit’s sister publication, PRODUCE BUSINESS, which was unveiled at the PMA Convention in San Diego on October 21, 2006, we published Food Safety Is A Retail Issue, which pointed out:
“…what holds suppliers back is not that they need an FDA regulation — it is that they need to see a willingness on the part of buyers to pay more to obtain a higher level of food safety and security. So far that is missing.”
The Buyer-led Initiative for Food Safety was then announced. In time it came to be signed on to by nine important buying organizations:

Here at the Pundit, we applauded the buyer-led effort but on October 30, 2006, ran a piece entitled Buyer-Led Food Safety Effort Leaves Open Question Of Buyer Commitment, in which we pointed out:
“What would be helpful from these buyers is…a reassurance to the grower/shipper/packer/processor community that investments in food safety will be protected.”
As Gene Harris of Denny’s added his endorsement to the Buyer-led Initiative for Food Safety, we published, Pundit’s Mailbag — Denny’s Weighs In On Food Safety Efforton November 1, 2006, and we pointed out that the Western Growers Association was now looking for mandatory standards:
“Buyers can impose standards on their suppliers, but it seems as if the big grower members of WGA are more inclined to go with a mandatory program. Perhaps because this is more easily “saleable” to consumers, perhaps because the growers have no confidence that buyers will ever agree to a uniform standard on food safety and, perhaps, because growers know that buyers today can have the best of intentions but situations change and buyer’s change — and if legal product is available for much less money, that will put a lot of pressure on an organization to change its standards.”
On November 2, 2006, we highlighted an Opportunity For Buyers’ Food Safety Initiative, where we wrote the following:
“Here’s the Pundit’s suggestion to the buyers: Don’t wait for the deadline to pass. Withdraw the letter to the associations, which can only lead to endless negotiations with grower/shippers and watered-down food safety standards. Instead, create a temporary ad hoc consortium to spearhead the quick development of science-based food safety standards.
In the short term, these will be enforced by buyer demand, hopefully including other buyers who will buy into the plan; in the medium run the plan will be turned over to state authorities in California and federal authorities in Washington, D.C., as the basis for new mandatory regulation.”
We pointed out that this initiative may not stay in the hands of the ad hoc group leading the Buyer-led Food Safety Initiative when, on November 7, 2006, we announced: National Restaurant Association Forms Produce Safety Working Groupand pointed out:
“What we should have learned from the FDA loss of confidence in the industry is that food safety is not something that we negotiate over. It has to be driven by the best scientific knowledge we have.”
Mark Munger of Andrew-Williamson Fresh Produce, a grower/shipper, pitched in his thoughts on the important role buyers play in the food safety arena and, on November 8, 2006, we published Pundit’s Mailbag — Insights From A Conscientious Grower, which specifically praised one foodservice customer:
I also have to commend one of our customers, who I believe demonstrates the value of collective partnerships between growers and customers. Two years ago we began working with Darden Restaurants. Darden takes food safety very seriously. They have empowered a food safety team that must approve each and every supplier. They have inspectors in the field who make weekly random inspections of growing operations, picking and packing programs. When problem issues are identified, they work closely with our food safety team to help educate our team and to ensure that collectively we fix the problem. The knowledge that an inspector can be in any field or packing shed at anytime has forced us to treat every day as an inspection day.
Additionally, Darden’s food safety team is separate from their buying team. If a farm is not up to par, they have the authority to stop all transactions until the problems are fixed. They truly put their money where their mouth is and have helped us become a markedly better company. I cannot think of a better example of the power of collective thinking between suppliers and customers. I think the industry would be well served to learn more about their programs and create similar models.
Not surprisingly, the Food Marketing Institute was not going to be content to sit this one out and, on November 10, 2006, we published FMI Steps Into The Food Safety Fray, which detailed a conference scheduled for December 5th at which FMI would host representatives from industry, associations, academia and government to advance food safety issues. Unfortunately, FMI decided to exclude the media and we pointed out:
“…if the goal is to build public confidence in the process the industry is going through, you not only open it to media, you send a velvet invitation to the big consumer media groups.
It smells of smoke-filled rooms where deals will be cut in secret. If you let in some light and air, everyone will have more confidence in the final product.”
On November 14, 2006, we published Pundit’s Mailbag: Grower/Shipper Calls Buyer Led-Food Safety Initiative Hollow Call To Action, in which a respected grower/shipper pointed out that “This is where the retailers must step out of their ivory towers and get their walk (vendor relationship) to match their talk (aligned supply chain)… If those who signed on to this letter would get committed to buying only from “qualified suppliers,” the laws of supply and demand will drive the solution and we will quickly catch up with the rest of the world in this critical area.”
On November 17, 2006, we featured Tale Of Two Buyers, in which we pointed out: “If the VPs are sincere about wanting the buyers to place food safety first, the VPs have the responsibility for changing the culture and the economic incentive systems.”
On November 21, 2006, we published Tim York Takes Leadership Role In Food Safety Crisis, which features an extensive interview with Tim York of Markon Cooperative as well as the announcement that the Buyer-led Food Safety Initiative gained ten new retail signatories:

Despite the impressive show of buyer support, we expressed some concern: “…it is also pretty clear that the prospect of one unified food safety standard acceptable to every one of the signatories, much less to those who have declined to sign, is somewhere between nil and nothing.”
On November 28, 2006, we published Words From Buyers Who Did Not Sign The Food Safety Initiative, and in this piece we added Mark Hilton, Vice President of Produce and Floral for Harris-Teeter, based in Matthews, North Carolina, as a signatory to the letter.
We also quoted buyers who had declined to sign the letter mostly due to their objection to the public nature of the initiative. We also pointed out how vendors were thinking:
Pundit Note: Many growers and shippers are irate over the effort as they see it as an evasion of responsibility. These buying organizations get exactly what they value enough to pay for. All too often, some of the same companies who signed the letter on Monday will, on Tuesday, buy some product without the slightest knowledge of where it came from.
On November 29, 2006, we ran Another Naysayer of Buyer-led Food Safety Initiative, which gave voice to the thoughts of some non-participating buyers that only mandatory government regulation is the way to go. Also on November 29, 2006, we published Pundit’s Mailbag — Buyers Lecturing Again, in which a processor there at the beginning of the national fresh-cut industry reminded us how uninterested in food safety most retailers were at the time.
On November 30, 2006, we continued our exploration of why some buyers were declining to join the buyer-led initiative with Self-Interests Play Role In Food Safety Initiatives. Also on November 30, 2006, we received a letter from Al Zuckerman of ProMark Group, which we focused on in Pundit’s Mailbag — Pundit Logic On Food Safety Regulation. We pointed out: “In terms of the difficulties on spinach and leafy greens, the key buyers are missing from the Buyer-led Food Safety Initiative. The buyers of the produce, in this case, are the processors.”
On December 1, 2006, we published Spinach And The Consequences Of Buyers’ Action, in which buyers who hadn’t signed on to the buyer-led food safety initiative pointed out that rigorous food safety systems will restrict supply and raise prices.
As we explained: “It is unknown if those who don’t buy spinach because of high prices will buy healthy alternatives. They may buy candy bars and die of complications of obesity. It is a completely open question as to whether safer spinach won’t cost lives in the end.”
Also on December 1, 2006, we responded to industry feedback claiming that foodservice did a better job than retail when it came to food safety by beginning a series of Pundit Pulses focused on foodservice. The first two, Pundit’s Pulse Of The Industry: Del Taco’s Janet Erickson and Notre Dame’s Dan Crimmins, dealt with how smaller buyers deal with these issues.
On December 5, 2006, we continued our discussion with buyers who refused to sign the Buyer-led Food Safety Initiative by noting that some of them weren’t thrilled with the Western Growers Association proposal either. Our Piece Is WGA’s Food Safety Proposal Up To The Job?dealt with the problems created for the industry when one region is declared “safer” than another and with the difficulty of utilizing a marketing order to legislate world class food safety practices.
On December 6, 2006, we ran Nine Days To B-Day (The Buyer-led Food Safety Initiative Deadline), which dealt with what will happen if the trade associations do not meet the deadline set by the buyers. Also on December 6, 2006, we continued our series on foodservice and food safety by running Pundit’s Pulse Of The Industry: Michael Spinazzola Of Diversified Restaurant Systems.
Additionally on December 6, 2006, we ran a letter from Tim O’Conner, President & CEO of the United States Potato Board in our Pundit’s Mailbag — Buying Safe Food In A Changing Worldin which Tim explained: “Given my experience with government inspection and regulation, I place much more value on a supply chain-led initiative to deliver meaningful long term results.”
